Privacy Policy

1. Information We Collect

The information we collect depends on how you use Starry and the features you choose to use.

A. Account and Contact Information

When you create or maintain a Starry account, we may collect your name, username, email address, telephone number, mailing or shipping address, date of birth, profile photograph, account preferences, verification status, and authentication information.

We use this information to create and secure your account, verify that you are eligible to use the Services, communicate with you, facilitate transactions, provide customer support, and operate Starry.

Starry is intended only for persons age eighteen (18) or older.

B. Listing and Item Information

When you submit an item for sale, we may collect photographs and information concerning the item, including its brand, category, material if known, size or estimated size, condition, flaws, description, asking price, optional minimum acceptable price, marketplace selections, shipping information, and other information you choose to provide concerning the item.

Information submitted for a listing may be transmitted to and publicly displayed on third-party marketplaces selected by Starry or used to facilitate the sale of your item.

C. Marketplace Information

Starry is designed to facilitate the listing and sale of items through third-party marketplaces.

Starry may operate marketplace seller accounts through which items submitted by Starry users are offered for sale. In that circumstance, we may provide listing information and other information reasonably necessary to facilitate the transaction to the applicable marketplace on your behalf.

Starry may also permit users to connect third-party marketplace accounts, including eBay and other supported marketplaces. Where a marketplace uses an authorization protocol such as OAuth, Starry may receive authorization tokens and marketplace account information necessary to provide the requested integration.

Starry does not request or store your eBay password through the eBay OAuth connection process.

Information received from connected marketplaces may include account identifiers, listings, offers, order and transaction information, fulfillment information, marketplace messages, shipping information, and account or listing status.

We use marketplace-derived information only as reasonably necessary to provide the marketplace functionality you request, administer transactions, maintain security, resolve disputes, comply with applicable law, and comply with the rules governing the relevant marketplace.

D. Buyer and Transaction Information

When an item sells through a third-party marketplace, Starry may receive information concerning the buyer or transaction, including buyer name, delivery address, order information, purchase amount, transaction status, marketplace identifiers, communications relating to the transaction, tracking information, and fulfillment status.

We use such information only as reasonably necessary to administer and complete the transaction, support shipping, address fraud or security concerns, resolve disputes, maintain legally required records, and comply with applicable marketplace requirements.

Marketplace communications may be retained while the transaction or related dispute remains active and thereafter only to the extent reasonably necessary for legitimate operational, legal, security, recordkeeping, or compliance purposes.

E. Offers and Seller Instructions

Starry may receive and process offers made on items listed through supported marketplaces.

If you enable a feature directing Starry to automatically accept offers at or above a minimum amount selected by you, Starry may automatically accept an offer that satisfies the instructions you provided.

This functionality implements your express transaction instructions. Starry does not use this feature to make employment, credit, housing, insurance, eligibility, or other decisions producing legal or similarly significant effects concerning an individual.

F. Shipping Information

Starry may create, obtain, facilitate, or deliver shipping labels, QR codes, tracking information, or other fulfillment materials.

To provide these services, we may process and disclose information such as the seller's name and address, buyer's name and delivery address, package information, order information, email address, telephone number where necessary, and tracking information to marketplaces, shipping carriers, and shipping-service providers.

G. Payments, Balances, and Payouts

Starry may maintain information concerning sales proceeds, Starry fees, available balances, pending balances, transaction history, and payout status.

Users may be offered payout options such as bank transfer, PayPal, Venmo, or another supported payout method, as well as the ability to maintain funds within a Starry account balance where available.

Starry does not intend to directly store complete payment-card numbers or full online-banking credentials. Financial information necessary to establish or process a payout may be collected and processed directly by the applicable payment, banking, or payout provider. Starry may receive limited information from those providers, such as a payment token, account type, partial account identifier, payout status, or transaction confirmation.

H. Communications

We collect communications you send to Starry, including customer-support inquiries, transaction communications, complaints, dispute information, and other correspondence.

We may also send account, security, transaction, shipping, offer, payout, and administrative communications necessary to provide the Services.

If you affirmatively opt in to transactional text messages, Starry may send SMS messages concerning activity such as sales, offers, shipping requirements, account security, or other requested service notifications. We do not currently use SMS messages for promotional marketing.

You may withdraw your consent to optional SMS communications using the method provided in the message or applicable account settings. Message and data rates may apply.

I. Technical and Usage Information

When you use the Services, certain technical information may necessarily be processed by Starry or our infrastructure providers, such as IP address, device type, operating system, browser or application version, login time, security events, crash information, and activity reasonably necessary to operate, secure, troubleshoot, and maintain the Services.

Starry does not currently request or collect precise GPS location from your device.

An IP address may reveal an approximate geographic area as an incidental function of Internet communications, but Starry does not currently use IP addresses to track users' physical movements or create precise location profiles.

J. Cookies and Similar Technologies

Our websites may use cookies, local storage, or similar technologies that are reasonably necessary for functions such as authentication, security, fraud prevention, session management, and maintaining user preferences.

Starry does not currently use third-party advertising cookies or tracking technologies to serve cross-context behavioral advertising.

If our practices materially change, we will update this Privacy Policy and provide any notice, consent, or opt-out mechanism required by law before using personal information in a materially different manner.

2. Information We Do Not Intentionally Seek

Starry does not ask users to provide information concerning race or ethnicity, religious or philosophical beliefs, health or medical conditions, sexual orientation or sex life, immigration or citizenship status, genetic information, biometric identifiers used for identification, Social Security numbers, or precise geolocation.

Please do not include unnecessary sensitive personal information in item descriptions, photographs, communications, or other materials submitted through the Services.

Starry may process account credentials and other information necessary to secure an account, but such information is used for authentication and account security purposes.

3. How We Use Personal Information

We use personal information only for reasonably necessary and appropriate business and operational purposes, including providing and maintaining the Services; establishing and securing user accounts; creating and managing listings; publishing items on third-party marketplaces; processing offers and seller instructions; facilitating sales, shipping, fulfillment, payouts, and account balances; communicating with users; providing customer support; preventing fraud, misuse, unauthorized access, and security incidents; enforcing our agreements and marketplace requirements; troubleshooting and improving the Services; maintaining transaction and business records; complying with legal obligations; responding to lawful requests; and protecting the rights, property, security, and safety of Starry, our users, marketplaces, and others.

We seek to limit our collection and use of personal information to information reasonably necessary and proportionate to those purposes.

4. Information Displayed on Third-Party Marketplaces

Starry is not intended to operate as a public social-networking marketplace. Starry does not currently provide public follower lists, public social profiles, public likes, or comparable social-networking functions within the Starry Service.

However, when an item is listed for sale, the item's photographs, description, price, condition, brand, size, and other listing information may become publicly available on one or more third-party marketplaces.

Once information is provided to a third-party marketplace, that marketplace's own terms and privacy policy also govern its processing of that information.

5. How and With Whom We Disclose Information

Starry does not sell personal information for money and does not currently share personal information for cross-context behavioral advertising or targeted advertising.

We may disclose personal information to the following categories of recipients when reasonably necessary to operate the Services:

Service providers are authorized to process information only for the services they provide to Starry or as otherwise permitted by applicable law and their agreements with us.

6. Special Treatment of eBay and Other Marketplace Information

Personal information obtained from eBay or another marketplace concerning a buyer or other marketplace user will not be used for unrelated advertising, marketing, profiling, sale, or other unrelated commercial purposes.

We process such information only as necessary to facilitate permitted marketplace activity, perform the transaction, provide the Services, maintain security, comply with marketplace requirements, or satisfy applicable legal obligations.

Starry will not use marketplace-derived personal information to send unsolicited promotional communications.

Information obtained from eBay will be deleted when required under our applicable retention practices, when it is no longer necessary for the permitted purpose, when required by eBay or the applicable eBay user, or as otherwise required under eBay's applicable developer requirements, subject to legal obligations that require retention.

Users may revoke an authorized marketplace connection in accordance with the marketplace's procedures and any functionality Starry makes available.

7. No Sale or Targeted Advertising

As of the Effective Date, Starry:

• does not sell personal information;
• does not use or disclose personal information for cross-context behavioral advertising; and
• does not operate third-party advertisements within the Starry application.

If Starry later introduces advertising or other processing that materially changes these practices, we will update this Privacy Policy before implementing the change and provide any notices, consent mechanisms, or opt-out rights required by applicable law.

8. Data Retention

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected or another permitted purpose.

The appropriate retention period may depend on the nature and sensitivity of the information, whether a transaction remains open, legal or contractual requirements, marketplace requirements, fraud and security concerns, tax or accounting obligations, disputes or claims, and technical backup requirements.

Following the applicable retention period, we may delete, destroy, or de-identify information unless continued retention is required or permitted by law.

Account deletion does not necessarily require immediate deletion of every transaction record. We may retain limited information when reasonably necessary for legal obligations, fraud prevention, accounting, security, marketplace compliance, dispute resolution, or the establishment, exercise, or defense of legal claims.

9. Account Deletion

You may request deletion of your Starry account and associated personal information through the account-deletion function within the Starry application or by contacting privacy@sellstarry.com.

We may need to verify your identity before processing a deletion request. Deletion is subject to lawful and contractual exceptions described in this Privacy Policy.

10. Your Privacy Rights

Depending on your state of residence and whether the applicable law covers Starry, you may have the right to confirm whether we process personal information about you; access personal information; correct inaccuracies; request deletion; obtain a portable copy of certain information; obtain information regarding the categories of third parties with whom information has been disclosed; limit certain processing; withdraw consent where processing depends on consent; opt out of sale, targeted advertising, or certain profiling; and exercise your rights without unlawful discrimination.

Because Starry does not currently sell personal information or process it for targeted advertising, those particular opt-out rights should not ordinarily be necessary under our current practices.

You may submit a privacy request by emailing privacy@sellstarry.com or through any privacy-request mechanism that Starry makes available within the Services.

We may take reasonable steps to authenticate your identity before fulfilling a request. You are not required to create a new Starry account merely to submit a privacy request.

We may decline or limit a request where permitted by applicable law, including where we cannot reasonably authenticate the requester, retention is legally required, complying would compromise security or the rights of another person, or another statutory exception applies.

11. Maryland Privacy Rights

If the Maryland Online Data Privacy Act applies to Starry's processing of your personal data, Maryland residents may have rights including confirmation of processing, access, correction, deletion, and portability of certain personal data, as well as applicable rights concerning sale, targeted advertising, and certain profiling.

To exercise a Maryland privacy right, contact privacy@sellstarry.com.

If Starry denies a Maryland privacy request, we will provide the reason for the denial and instructions for appealing the decision where required by law.

To appeal, email privacy@sellstarry.com with the subject line PRIVACY APPEAL and explain why you believe the decision should be reconsidered.

Where applicable law requires it, we will process an appeal within the time provided by law and provide information concerning any further complaint rights.

12. California and Other U.S. State Privacy Rights

Residents of California, Colorado, Connecticut, Virginia, Texas, and other states with applicable comprehensive privacy laws may possess additional rights or receive additional protections under those laws.

Where such a law applies to Starry, we will honor the rights and disclosures required by that law.

Nothing in this Privacy Policy is intended to limit a privacy right that cannot lawfully be waived.

Starry does not discriminate against a user because the user exercises a privacy right protected by applicable law.

13. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, use, alteration, loss, destruction, or disclosure.

Depending on the system and information involved, safeguards may include encryption in transit, encryption or comparable protections where appropriate, access controls, authentication controls, restricted credential access, secure storage of marketplace authorization tokens, monitoring, logging, and security practices imposed on service providers.

No method of transmission, system, or storage technology is completely secure. Accordingly, we cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of your Starry account credentials and for notifying us if you believe your account has been compromised.

14. Children and Age Restrictions

Starry is intended exclusively for persons who are at least eighteen (18) years old.

We do not knowingly permit persons under eighteen to create Starry seller accounts.

If we learn that an individual under eighteen has created an account or provided personal information in violation of this requirement, we may suspend or terminate the account and take reasonable steps to delete the information, subject to applicable legal requirements.

15. United States-Only Service

Starry is currently intended for users located in the United States.

We are not presently offering the Services specifically to residents of the European Economic Area, United Kingdom, or other foreign jurisdictions.

Information may nevertheless be processed by infrastructure or service providers in locations permitted by applicable law and contractual arrangements.

16. Third-Party Services

Starry integrates with or links to services operated by third parties, including marketplaces, payment and payout providers, shipping providers, and other service providers.

Starry does not control those parties' independent privacy practices. Information processed directly by a third party is also subject to that third party's privacy policy and terms.

You should review the privacy policies of third-party services you use in connection with Starry.

17. Business Transfers

If Starry is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, insolvency, receivership, or similar corporate transaction, personal information may be disclosed or transferred as part of that transaction, subject to applicable law and appropriate confidentiality or privacy protections.

18. Legal, Security, and Fraud Disclosures

We may preserve, use, or disclose information where reasonably necessary to comply with applicable law, regulation, legal process, court order, subpoena, or governmental request; investigate, detect, prevent, or address fraud, security incidents, unlawful conduct, violations of our agreements, or misuse of the Services; protect the rights, property, or safety of Starry, our users, third parties, or the public; or establish, exercise, or defend legal claims.

19. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in the Services, our information practices, marketplace requirements, or applicable law.

When we update the Privacy Policy, we will revise the Effective Date.

If a change materially affects how we use personal information, we will provide additional notice or obtain consent when required by applicable law.

We will not rely on a materially revised policy retroactively where applicable law requires additional notice or consent.

20. Governing Law

To the extent a governing-law provision is legally applicable to this Privacy Policy, this Privacy Policy is governed by the laws of the State of Maryland, without regard to conflict-of-law principles.

This provision does not limit any consumer or privacy right that cannot lawfully be waived, restricted, or displaced under applicable federal or state law.

Any separate contractual provisions concerning venue, dispute resolution, arbitration, class-action waiver, limitation of liability, or similar matters will be governed by Starry's applicable Terms of Service rather than this Privacy Policy.
